These Terms of Service (“Terms”) govern your access to and use of the MERACH website, products and services provided through this website (the “Site”).
Throughout the Site, the terms “MERACH”, “we”, “us” and “our” refer to MERACH, LLC, a company registered in the United States.

By accessing our Site or purchasing any products or services from us, you agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy (collectively, the “Agreement”).

For customers purchasing through this Australian-facing website, all transactions are entered into with MERACH, LLC.Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies available to consumers under the Australian Consumer Law (ACL), which may apply to customers located in Australia.

If you do not agree to these Terms, you must not access the Site or use our products or services.

1. ELIGIBILITY AND ACCOUNT RESPONSIBILITY

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to place an order or create an account on this Site.

You are responsible for maintaining the confidentiality and security of your account credentials and for all activities conducted under your account. You must ensure that all information you provide is accurate, current, and complete.

We reserve the right to suspend or terminate accounts that are used in violation of these Terms or applicable law, subject to your rights under Australian Consumer Law.

2. PRODUCTS AND INFORMATION ACCURACY

We make reasonable efforts to ensure that product descriptions, images, specifications, and prices displayed on the Site are accurate.
However, product appearance (including colour) may vary depending on your device or display settings.

We reserve the right to update, modify, or discontinue any product at any time, subject to existing orders and applicable consumer guarantees.

3. ORDERS AND ACCEPTANCE

By placing an order, you make an offer to purchase products subject to these Terms.
An order is not accepted until we confirm acceptance and payment has been successfully processed.

We may decline or cancel an order where permitted by law, including due to suspected fraud, pricing errors, or product availability issues. If an order is cancelled, any payment received will be refunded in accordance with applicable law.

4. PRICING, TAXES AND PAYMENT

All prices are displayed in Australian Dollars (AUD) unless otherwise stated.

Prices may change without notice. The price charged will be the price shown at the time your order is placed.
Prices may not include shipping fees or applicable taxes remember these will be shown at checkout before payment confirmation.

You agree to provide valid, current, and accurate payment information and authorise us to charge your selected payment method.

5. SHIPPING AND DELIVERY

Shipping times are estimates only and are not guaranteed.
Delays may occur due to carrier issues, weather events, or circumstances beyond our reasonable control.

Risk of loss passes to you upon delivery of the products to your nominated address.
This clause does not limit your rights under Australian Consumer Law in relation to lost or damaged goods.

6. RETURNS AND REFUNDS (ACL COMPLIANCE)

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled: to cancel your service contract with us; and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies available to you under the Australian Consumer Law.

Where products are faulty, not as described, or fail to meet consumer guarantees, you are entitled to remedies under the ACL, including repair, replacement, or refund, as applicable.

7. SUBSCRIPTIONS AND AUTOMATIC RENEWAL (IF APPLICABLE)

If we offer subscription-based products or services:

  • Subscription pricing, billing frequency, and renewal terms will be clearly disclosed prior to purchase.

  • Subscriptions automatically renew unless cancelled before the remember next billing date.

  • You may cancel a subscription at any time through your account or by contacting customer support.

  • Cancellation will take effect at the end of the current billing period unless otherwise required by law.

  • We will not charge you after cancellation.

These subscription terms are provided in accordance with Australian Consumer Law and applicable automatic renewal requirements.

8. INTELLECTUAL PROPERTY

All content on this Site, including trademarks, logos, text, images, graphics, videos, and software, is owned by or licensed to MERACH and is protected under Australian and international intellectual property laws.

10. DISCLAIMER OF WARRANTIES (ACL SAFE)

The Site and products are provided on an “as is” and “as available” basis.

To the extent permitted by law, we do not make representations or warranties other than those expressly required under Australian Consumer Law.

This disclaimer does not exclude any non-excludable consumer guarantees under the ACL.

11. LIMITATION OF LIABILITY (ACL CARVE-OUT)

To the extent permitted by law, MERACH is not liable for indirect, incidental, or consequential loss arising from your use of the Site or products.

Nothing in these Terms limits or excludes liability that cannot be excluded under Australian Consumer Law, including liability for death or personal injury caused by negligence, or failure to comply with consumer guarantees.

12. PROHIBITED USES

You must not use the Site:

  • For any unlawful purpose;

  • To infringe intellectual property rights;

  • To distribute malware or malicious code;

  • To interfere with the operation or security of the Site.

We may restrict access where misuse is identified, subject to applicable law.

13. TERMINATION

We may suspend or terminate access to the Site where reasonably necessary to protect our business, customers, or comply with law.

Termination does not affect rights or obligations that accrued prior to termination, including consumer rights under ACL.

14. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.

15. WAIVER

Our failure to enforce any right under these Terms does not constitute a waiver of that right.

16. ENTIRE AGREEMENT

17. ASSIGNMENT

You may not transfer your rights under these Terms without our prior written consent.
We may assign or transfer our rights as part of a business restructure, merger, or sale, in accordance with law.

18. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the United States, without prejudice to any mandatory consumer protection laws applicable in Australia, including the Australian Consumer Law.
